This document makes up our Terms Of Service, a legally binding contract between the customer (you) and EHD Concrete Sleepers (us/we). This contract sets out your rights and responsibilities when you use any services provided by us, including accessing our website (ehdconcretesleepers.com.au) and purchasing our products/goods.

 

Placing Orders

We accept orders online, via email and over the phone:

  • An online order can be placed on our website by adding at least one product to your cart and following the checkout process. An online account is not required to place an order but can be created and is useful for maintaining contact details and viewing order history. The account holder is responsible for keeping contact details accurate and the password secure. Online ordering is provided in good faith and we do not guarantee its performance or availability.
  • An email order can be placed by sending details to orders@ehdconcretesleepers.com.au.
  • A phone order can be placed by calling +61 2 4407 8290.

Orders will not be processed or a delivery/pickup date provided until payment has been received in full. All items on an order will be prepared for delivery/pickup at the same time. Please create a separate order if you require split delivery/pickup.

 

Product Prices

All prices published on our website are in Australian dollars and inclusive of Australian Goods & Services Tax (GST). Trade discounts are automatically applied for authorised customer with an online account. Please contact us to assist in setting up your account. Prices are subject to amendment without notice due to fluctuations in the cost of raw materials.

 

Payment Methods

No agreement exists for an order until it has been paid in full. Payment can be made by credit/debit card or bank transfer. The invoice will be emailed to the address provided on the order after payment has been made. Changes to an order or late payment of an invoice may result in delivery/pickup delays. Non-payment of an invoice will result in cancellation of the order.

 

Delivery and Local Pickup

Once an invoice has been paid the delivery/pickup will be scheduled for the first available time to suit both parties but no less than 24 hours later. Partial delivery/pickup of orders is not permitted. You are responsible for the goods once delivery/pickup is complete. Goods not delivered/picked up within 14 days will be restocked or subject to storage fees.

Deliveries will be made using our own trucks during our business hours and arrival time notified by the driver on the day using the phone number provided on the order. All deliveries will be made to the street frontage of the address provided on the order, unless alternate arrangements are made with the driver at time of delivery and safe access is available. You or a nominated representative must be onsite to receive and accept the delivery. Delays in delivery may occur due to unforeseen circumstances, in which case you will be notified as soon as possible.

Local pickups are made from our factory premises during our business hours. A vehicle suitable for carrying the order must be used, otherwise pickup will not be permitted. A vehicle suitable for forklift loading must be used, otherwise you will need to hand load the order.  Any delays in pickup should be notified to us at your earliest convenience.

 

Returns and Refunds

Any goods that have not been used and are in original condition may be returned for a refund, except for custom orders. We will charge a delivery fee to pickup the goods, if required, and a 20% restocking fee. The balance of the invoiced amount will be refunded by the same method used for payment. We do not warrant the use of products outside the definition of our engineering, available on request. Any product that is deemed to be faulty through approved use will be repaired, refunded or replaced in accordance with the Australian Consumer Law (ACL).

 

Website Security

Our website is managed on a secure server in Australia and protected by an SSL (Secure Sockets Layer ) certificate. While this means data to and from the website is encrypted we cannot guarantee against the inherent risks of using the internet and hackers stealing customer information.

 

Indemnities and Limitation of Liability

All care has been taken in preparing our website but no responsibility can be taken for errors and omissions.  We make no representations or warranties of any kind, express or implied, as to the operation of our website. We will not be liable for any damages of any kind arising from the use of this site, including but not limited to, direct, indirect, incidental punitive and consequential damages.

 

Intellectual Property

The site or any portions of the site may not be reproduced, duplicated , copied or otherwise exploited for any commercial purpose that is not expressly permitted.
